Fetch my Debt

In subscribing to this credit reference database, customers acknowledge and agree to be bound by the terms and conditions of trade as set out below, as varied from time to time by Fetch my Debt Pty Ltd by notice in writing.

• To report default accounts to the Fetch my Debt Childcare Credit Reference service on a regular basis;
• To pay the prescribed fees to Fetch my Debt (including any GST payable), for Childcare Credit Reference services applied to me/us by Fetch my Debt, with such payment to be made by the invoice due date and in a manner determined by Fetch my Debt;
• That Fetch my Debt will provide invoices and or any other documentation, that may be necessary or desirable to enable or assist me/us in claiming any credit, set-off, rebate or refund in relation to any amount of GST paid or payable pursuant to any payment made by me/us under this contract;
• To supply Fetch my Debt as requested from time to time with the particulars of persons dealing with me/us in accordance with any applicable legislation and any requirements of Fetch my Debt;
• To respect the sensitive nature of the information that the Fetch my Debt Childcare Credit Reference service provides and to comply with all legislation regarding the handling of that information;
• Not to knowingly seek the disclosure from the Fetch my Debt Childcare Credit Reference service of any personal information from any such credit information files kept by Fetch my Debt where disclosure of such information would give rise to a contravention by Fetch my Debt of the provisions of Section 18k or other sections of the Privacy Act 1988 (as amended) as may apply;
• That Fetch my Debt obtains all information on its database from its customers or other third parties and relies on those suppliers to ensure that the information is accurate;
• That Fetch my Debt does not independently verify information supplied to it and hence does not guarantee the accuracy of any information supplied to me/us. Fetch my Debt is not liable for any claim, loss or damage suffered by me/us resulting from or arising out of any information supplied by Fetch my Debt;
• That Fetch my Debt excludes all liability in any course of action whatsoever for loss or damage arising out of or in connection with any decision made using information supplied by Fetch my Debt, including without limitation, loss of profits and damage suffered as a result of claims by any third person;
• To indemnify Fetch my Debt Pty Ltd in respect of all:
  (a) demands, claims, actions, proceedings, or suits brought against Fetch my Debt Pty Ltd, whether in law or equity;
  (b) liabilities of Fetch my Debt Pty Ltd; and
  (c) costs and expenses including legal costs and expenses (on a solicitor and own client basis) incurred by Fetch my Debt Pty Ltd arising directly or indirectly out of the use or reliance on the information
• Nothing in these terms excludes or limits Fetch my Debt 's or my/our liability for breach of any condition or warranty implied by the Trade Practices Act that cannot be excluded or limited;
• To comply with all applicable legislation (including any of our obligations under the Privacy Act 1988) and all other regulatory requirements in using this service;
• To advise Fetch my Debt promptly of any change in the ownership or control of my/our business/company that may affect my/our ability to satisfy these terms and conditions;
• In the event of a breach of the foregoing terms and conditions, Fetch my Debt may suspend or cancel my/our access to the Fetch my Debt Childcare Credit Reference service, or seek any other relief that may be available to it; and
• That it remains my/our responsibility to comply with all the outlined conditions above.
